Building permit
Building permit can refer to the whole building plan or in case of a bigger project only some indicated part of it.

The application and all the documents connected with issuing the decision must be submitted in the Urban Planning and Architecture Department. Those documents are verified and proceedings are conducted in order to  examine any possible motions and  reservations by the parties involved.

The parties in the conduct / proceedings of obtaining the building permit are as follows: the investor and the proprietors, the perpetual users or the administrators of the properties being under possible impact of the object.

The decision expires after three years from the date of its coming into force or if the construction works are interrupted for a period of more than 3 years.

The department responsible: Urban Planning and Architecture Department 

The documents required:
•    an application for a building permit /form no. 2/;

•    a statement about the possessed right to have the property at one’s disposal aimed at  building

•    4 copies of the building project along with opinions, agreements, permits and other documents required by special laws and regulations as well as building qualifications and certificates confirming that the designer belongs to the Chamber of  Professional Council;

•    Decision about the building development conditions and area development (if the investment area is not included in the local master plan);

•    A specialist opinion, the one in question in Art.33 sec.3 of the Act – building law (if required – it involves nuclear power industry objects, refinery,  chemical plants, dams or projects including unchecked technical solutions which have legal basis neither in the currently binding regulations nor Polish standards);

•    A resolution about an agreement with a proper body of architectural and building administration referring to objects of mining plants and objects situated in closed (self-contained) areas;

•    An authorization granted to a person acting on behalf of the investor (if there is one).

Fees/charges:
The payment for the building permit for a building object and the building equipment connected with the building site is diversified and it amounts to:

a)    for a building designated for a business activity different from agricultural or forestry one – PLN 1.00 per each qm. of the floor surface  (not more than PLN 539.00)
b)    for a building aimed at  farming on an arable farm - PLN 14.00
c)    for any other building - PLN 48.00
d)    for a well and the devices for removing regular impurities and sewage - PLN 20.00
e)    for buildings connected with agricultural production - PLN 112.00
f)    for water supply systems,  sewage systems, electro-energy systems, telecommunications systems, gas systems, heating systems and roads, except for access (service) roads,  the approaches to the buildings and exits of the road,  on the stipulation of the point g) -  PLN 2,143.00
g)    for water supply systems, sewage systems, electro-energy systems, telecommunications systems and gas systems of  the length of up to 1 km - PLN 105.00
h)    for  other buildings - PLN 155.00
i)    for the building equipment connected with the building objects - PLN 91.00
j)    a charge for approval of the building project - PLN 47.00
k)    a charge for a permit for  the redevelopment or  renovation of a building object and for renewal of building works - 50% of the aforementioned rates
l)    a charge for a demolition permit  of a building object - PLN 36.00
m)  a charge for transferring the decision of a building permit or a decision of renewal of  construction works  for a third party - PLN 90.00

In case of issuing a permit for building a building with a living function, while calculating the charge  living area of the building is not included.

In case of issuing a building permit including more than one building object mentioned in the section hereof, the revenue charge is calculated for each object individually.

Deadlines:    65 days from the date of submitting an application form and the required materials

Legal basis: :  The Act dated 07 July 1994 – Building Law (harmonized text: Law Gazette from 2006 r. No. 156 , item. 1118 with further amendments).
