Carrying out demolition works
Construction works that consist in carrying out the demolition of the structures and the buildings situated in the real estate require an approval. Demolition works cannot be started until a final decision about the demolition permit is obtained.
Demolition of some buildings and structures requires only a notification about the works. In the notification a kind, a range and the method of making the demolition works shall be determined and clarified.
The demolition works can be started before accepting the notification or issuing the permit, if they aim at removing direct threat to the safety of people or possessions. Starting such works does not exempt from the obligation of notifying or obtaining the permit.
NOTIFICATION OF BUILDING OBJECTS DEMOLITION
The department responsible: Urban Planning and Architecture Department
Documents required:
• Notification of the demolition of building objects – an application /form no. 12/;
• A statement about possessing a right to have the object/real estate at one’s disposal;
• Duplicate of the documentation including: a site plan; kind, range and methods of carrying out the works; work starting time.
Fees/charges: free of charge
Deadlines: one can start building works if within 30 days from the date of submitting the notification, the proper body does not refuse it in a form of a decision, and no later than after 2 years from the starting date determined in the notification (application)

DEMOLITION PERMIT
Documents required:
• An application for a demolition permit /form no. 13/;
• A statement about the right to have the real estate at one’s disposal;
• A drawing of the building object site, a description of the range and methods of carrying out the demolition works, the description of the methods of ensuring safety to people and possessions;
• Permits, agreements and opinions of other bodies;
• Depending on to what degree the demolition works are complicated the following documents are required:
- 4 copies of the building projects along with the opinions, agreements, permits, and any other documents required by special regulations;
- building qualifications and certificates proving that the designer belongs to the chamber of professional council;
• An authorization given to the person acting on behalf of the Investor (if there is one)
Fees/charges:
PLN 36.00 - for issuing a permit
Deadlines:
65 days from submitting the application form and the required materials.
