Decision about the conditions of the building development and the area development
Unless there is legally binding local master plan, the Investor should apply for issuing a decision about the conditions of the building development.
 

In the application the Investor must indicate, among others, the boundaries of the area  indicated in the application as well as the characteristics of the investment including: determining the  demand for the technical   infrastructure, and a planned  way of the area development as well as a description of the building and the area development, including the designation and the dimensions of the designed building objects,  distinctive technical parameters of the investment and the data characterizing its impact on the environment.

The department responsible: Urban Planning and Architecture Department 
 

Required documents:
•    Application for issuing the conditions of the building development and area development for undertakings with no significant impact on the environment /form no. 6/;

•    Duplicate of the base map and the  identification map (record) with marking the investment area and the boundaries of the area which the application refers to;

•    Initial information obtained from appropriate institutions:
- concerning providing supplies of: water, electric energy, gas (along with the indication of  the area of drawing) /Adresses

- concerning possibilities of providing transport services  /Road and Transport Department of the City Hall, 21 Graniczna Street, Road and Transport Department  Office no. 316, 3rd floor, tel. no. 0048/ 32 295 67 57. Required documents: a base map at a scale of 1:1000 or 1:500 along with marked proposed location; a general orienteering plan at a scale of 1:10.000 or 1:25.000 along with marking an occupied section of the road lane .

Fees/charges:  
 
a)   PLN 107.00 – for issuing a decision
b)    PLN 56.00 – for transferring the decision  for other person

There is no revenue fee for all the decisions establishing the conditions of the building development and area development referring to housing investments

Deadlines:
*  30 days from submitting the application and the receipt for the payment
* If the case is  particularly complicated the deadline can be prolonged up to 2 months

Legal basis: The Act of 27 March  2003 considering spatial planning and development (Law Gazette from 2003 No. 80 item 717 with further amendments)
