Environmental decision
In case of undertakings that can have an impact on the natural environment and the undertakings that can have a potentially significant impact on the environment it is necessary to obtain a decision about the environmental conditions for them.
There is a list of those undertakings included in the Government Order of 9 November 2004 about determining kinds of undertakings having a significant impact on the natural environment and detailed conditions connected with qualification of an undertaking for making a report on influencing the environment (Law Gazette from 2004 No 257, item 2573 with further amendments).
For part of the investment within the procedure of obtaining a decision it is required to make an additional report – an assessment of the impact of the undertaking on the environment.
The department responsible: Environment Protection and Agriculture Department
Required documents:
• an application for issuing a decision about environmental conditions of the approval of the undertaking to be carried out;
• A copy of the identification map attested by a proper body including both the area where the investment is due to be carried out as well as the area where the investment is going to have an impact;
• Triplicate of an information card about the planned undertaking– in case of undertakings described in §3 of the Government Order of 09.11.2004 concerning determining kinds of undertakings that can have a significant impact on the environment and detailed conditions connected with qualifying the undertaking for making a report on its environmental impact (Law Gazette 257 item 2573 with further amendments.) + a copy on a CD;
• Triplicate of the report on the environmental impact of the undertaking - In case of undertakings that can always have a significant impact on the environment described in §2 of the Government Order dated 09.11.2004 concerning determining kinds of undertakings that can have a significant impact on the environment and detailed conditions connected with qualifying the undertaking for making a report on its environmental impact (Law Gazette No. 257 item 2573 with further amendments) + a copy on a CD;
• Excerpt of land records including the area where the investment is due to be carried out as well as the area where the investment is going to have an impact
Fees/charges:
a) PLN 205.00 – for issuing a decision
b) PLN 17.00 – for the submitted letter of attorney
Deadlines: due to the specificity of the problem, proceedings are always treated in an individual way. Unless the case needs any further explanation or clarification – up to 30 days. An average time period of the expectation for the permit is 2 months.
Legal basis: The Act of 3 October 2008 considering making information about environment and its protection available, and the participation of the society in the environment protection, and assessments of the impact on the environment (Law Gazette from 2008 No. 199, item 1227 with further amendments).
